Protect Marylanders from Higher Costs

Limits on non-economic damages have been shown to keep prices low, reduce excessive lawsuits, and slow the pace of insurance cost increases.

Maryland is a generous and compassionate state. It allows more types of non-economic damages to be awarded than neighboring states that do not have caps.

Dramatically raising or eliminating Maryland’s cap could increase both legal fees and insurance rates, making it more expensive for residents and businesses. That hurts Maryland at a time when the state can least afford it.

We don’t need to drastically change how lawsuit amounts are calculated, or risk causing ripple effects across the legal system.

Similarly, now is not the time for legislators to eliminate or dramatically raise the existing cap on medical malpractice claims. Instead, the General Assembly should look to protect consumers involved in lawsuits by increasing transparency and accountability on lending companies doing business in Maryland.
